Family-based Immigration

U.S. citizens and lawful permanent residents (green card holders) are able to sponsor certain family members to join them in the United States. U.S. Citizens may sponsor spouses, parents, siblings, adult sons and daughters, and children; permanent residents may sponsor spouses, unmarried adult sons and daughters, and children.

Spouses, parents, and children of U.S. citizens are considered “immediate relatives.” There is no annual limit on the number of immigrant visas available for immediate relatives. Other qualified family relationships are considered “family preference” categories, for which there is an annual limit on immigrant visas.

Chenhalls Nissen, S.C. assists clients with the process of preparing and filing Form I-130 (Petition for Alien Relative) with USCIS. Once the petition is approved and a visa number becomes available (if necessary), the family member of the citizen or permanent resident may apply for permanent residence, either through consular processing if they are outside the United States, or through adjustment of status if they are in the United States. Our attorneys offer guidance and advocacy at every step of these processes, as well as any follow-up processes that may be needed, such as removal of the conditions on residency, renewals of permanent resident cards, or naturalization, for example.
